Birthers and Obama's birthday
Coming on President Obama's 49th birthday, a new CNN/Opinion Research poll finds that 11 percent of Americans feel the 44th president was definitely not born in the U.S., with an additional 16 percent saying he "probably" was not not born here.
The "birther " movement still lives in the Republican Party, according to the poll taken July 16-21.
"Not surprisingly, there are big partisan differences, although a majority of Republicans think Obama was definitely or probably born here," said Keating Holland, polling director at CNN.
But a total of 41 percent of Republicans surveyed said that Obama was "definitely" or "probably" not born in the U.S.
Overall, however, 42 percent of Americans say the president was "definitely" born here, with an additional 29 percent saying he was "probably" born in the USA.
Hawaii has produced a copy of its "certificate of live" birth testifying to the fact that Obama was born in the 50th state. Two birth notices ran in Honolulu newspapers.
Gov. Linda Lingle of Hawaii, a Republican who campaigned in 2008 for John McCain, has declared: "The president was in fact born at Kapi'olani Hospital in Honolulu, Hawaii, and that's just a fact."
Still, the "birthers" have been egged on by former CNN pundit Lou Dobbs, and House Tea Party Caucus organizer Rep. Michele Bachmann, R-Minnesota. On his radio show Wednesday, right-wing pundit Rush Limbaugh declared: "They tell us August 4th is his birthday: We haven't seen any proof of that."

Hawaii Denies Requests for Obama's Birth Certificate

Hawaii has a message for those who question whether President Barack Obama was born there: Get off our backs! The state Department of Health (DOH) set up a special page on its website to help handle dozens of requests it receives monthly from "birthers" trying to obtain evidence of the President's origins. And Democratic state Senator Will Espero recently introduced two bills in an attempt to stem the tide.
Senate Bill No. 2056 would reverse current state law by allowing more open access to birth records inspection, and Senate Bill No. 2937 would allow the State Health Department to ignore illegitimate requests for vital records by labeling abusers of the system as "vexatious requestors." Espero told the Honolulu Advertiser his reason for introducing the bills. "It's because of all the noise about the president not being born here. I believe he's born here. Most of Hawai'i believes he's born here, and it's not an issue as it is with these Mainland birthers."
The Health Department website explains that current state law "prohibits the DOH from disclosing any vital statistics records ... unless the requestor has a direct and tangible interest." Release of birth certificates is limited in most cases to immediate family, legal guardians, or executors.
According to Health Department spokesman Janice Okubo, the state receives 40 to 50 requests for Obama's birth certificate each month, as reported by the Honolulu Advertiser. Okubo says that the law is necessary to protect against "identity theft and other types of concerns." She also complained that the requests place a heavy burden on DOH staff already severely strained by recent budget cuts.
Birthers maintain Obama is not eligible to be president because, they say, he was not born in the United States. They claim he was born in Mombosa, Kenya, and that his mother traveled to Hawaii shortly after his birth.
DOH Director Dr. Chiyome Fukino issued a statement in 2008 stating that both he and the Registrar of Vital Statistics "have personally seen and verified that the Hawai'i State Department of Health has Sen. Obama's original birth certificate on record in accordance with state policies and procedures." He followed up with another statement in July, 2009, saying simply that he has "seen the original vital records maintained on file by the Hawai'i State Department of Health verifying Barack Hussein Obama was born in Hawai'i and is a natural-born American citizen."
The major media is quick to label birthers as extremists not worthy of consideration. White House Press Secretary Robert Gibbs mockingly told a reporter at a press briefing in July 2009, "The noble truth is that the president was born in Hawaii, a state of the United States of America."
But that isn't good enough for birthers, who demand to see the actual document instead of the less complete Certificate of Live Birth issued by Obama's presidential campaign. Hawaii law allows parents of children born out of state to obtain certificates of live birth, a fact that prompts birthers to believe Obama has something to hide in not revealing the original long form birth certificate.
The topic has sparked a number of court cases. Prior to the 2008 presidential elections, Pennsylvania Democrat Philip J. Berg filed suit in U.S. District Court challenging Obama's eligibility to run, but the court dismissed the case in 2009.
U.S. Army Sergeant Steven F. Cook, a soldier ordered to Afghanistan, sued in 2009 for a temporary restraining order on his deployment based on Obama's ineligibility to be commander-in-chief. A California judge agreed to hear the case. However, the LA Independent reported that the army revoked Cook's deployment orders before the hearing date.
In response to birthers' concerns, U.S. Representative Bill Posey (R-Fla.) introduced H.R. 1503, a bill to require future presidential candidates to provide documentation proving they meet Constitutional requirements for eligibility to the office of president. The bill has 11 cosponsors but in the year since its introduction still awaits a committee hearing. Regarding Obama's birth certificate, Posey told WorldNet Daily, "The only people I know who are afraid to take drug tests are the people who use drugs."

Below are responses to frequently asked questions related to all records and documents maintained by the Hawaii State Department of Health (DOH) related to the vital records of President Barack Hussein Obama II. Frequently requested records and documents which can be released to the public are attached by electronic link below or, for those records and documents that are not available electronically, directions are provided for requesting copies.
The State’s public records law, the Uniform Information Practices Act (Modified) (“UIPA”), found at chapter 92F, Hawaii Revised Statutes (“HRS”) requires that all government records be open to public inspection unless access is restricted or closed by law. Government records means information maintained by an agency in written, auditory, visual, electronic, or other physical form, see HRS §92F-3. The UIPA does not require an agency to provide access to government records that state law protects from disclosure, see, HRS §92F-13 (4), nor does it require agencies to respond to all questions asked of the agency.
Unless a request for DOH records is specific enough to be understood, the request cannot be responded to by the DOH.
The DOH may not have a record which is responsive to a request. The UIPA does not require an agency to compile or create information to respond to a request.
State law prohibits the DOH from disclosing any vital statistics records or information contained in such records unless the requestor has a direct and tangible interest in the record, or as otherwise allowed by statute or administrative rule. See HRS §338-18. Direct and tangible interest is determined by HRS §338-18(b).
In light of the unprecedented number of requests for information relating to the vital records of President Barack Hussein Obama II, the DOH has reviewed the requirements of UIPA and the confidentiality provisions of HRS Chapter 338.
Based upon that review, the DOH has determined that the information listed below constitutes all of the publicly available information related to requests for vital statistics records pertaining to President Barack Hussein Obama II, and the only disclosures pertaining to those records that can be made in accordance with Hawaii law. The Department of Health is providing links to copies of the records in the form that they are available to the public.

State law prohibits the DOH for disclosing any information about a Hawaii vital record unless the requestor has a direct and tangible interest in the record. This includes verification of vital records and all the information contained in a record. Vital records disclosure laws protect all birth, death, marriage and divorce records held by the department and all amendments, changes, supporting records, and requests related to vital records.

Records pertaining to the Department of Health database for vital statistics information are not required to be disclosed by the Uniform Information Practices Act because those records, by their very nature, must be confidential in order for the government to avoid the frustration of a legitimate government function (see HRS §92F-13(3)). Disclosing such information compromises the department’s ability to protect the integrity of vital statistics records, to ensure their proper use, and to ensure the efficient and proper administration of the vital statistics system as is required by HRS §338-18.

In a related matter, under growing pressure from several groups, Justice Antonin Scalia announced that the Supreme Court agreed on Tuesday to hear arguments concerning Obama's legal eligibility to serve as President in a case brought by Leo Donofrio of New Jersey . This lawsuit claims Obama's dual citizenship disqualified him from serving as president. Donofrio's case is just one of 18 suits brought by citizens demanding proof of Obama's citizenship or qualification to serve as president.
Gary Kreep of the United States Justice Foundation has released the results of their investigation of Obama's campaign spending. This study estimates that Obama has spent upwards of $950,000 in campaign funds in the past year with eleven law firms in 12 states for legal resources to block disclosure of any of his personal records. Mr. Kreep indicated that the investigation is still ongoing but that the final report will be provided to the U.S. attorney general, Eric Holder. Mr. Holder has refused to comment on the matter.

It’s no surprise that Hillary Clinton is in Kenya today to reinforce the cover-up.
I don’t trust ANY politician and almost no one in the media. I still want answers. Obummer, put up or get out!!!! All he has to do is make the following official public statement,
“I Barack Obama authorize the State of Hawaii to release and make public all of my records on file.”
That’s it. Issue over. But he won’t because he’s a fraud!! Obama knows that millions of citizens want to see it yet he continues to hide it. What/why is he hiding? and most disturbingly, why don’t BHO’s supporters want to know the whole truth, especially since there’s a reward of $100,000 for proof that Obama is a “natural born” citizen of the United States.

The Obama Kenyan birth certificate was presented by the lawyer who has become the birthers unofficial ruler. Orly Taitz released the alleged Kenyan birth certificate over the weekend, claiming that it is the final proof the birthers have been looking for.
According to the birth certificate, Barack Obama was born in Coast General Hospital in Mombassa, Kenya, on August 4, 1961. Though there is no doctor listed, the certificate is signed by the Coast Province deputy minister.
Orly Taitz is out to get the Obama Kenyan birth certificate authenticated by the U.S. District Courts. She claims that the document was given to her by someone who is "afraid for his life" which pretty much furthers the theory that the Obama administration would commit murder to keep Obama in office.
The Obama Kenyan birth certificate comes after a week in which the birther movement officially got into the mainstream of media attention. Lou Dobbs took up their cause, while liberal media comedians like Stephen Colbert and Bill Maher tore the birthers apart. Taitz herself was interviewed by Colbert several days ago.
However, the birthers are now set to take the conspiracy theory to the next level, since they now have something that they claim as proof. If Taitz can get the Obama Kenyan birth certificate analyzed by the courts, it will legitimize the birthers .

Attorney files motion for authentication of alleged 1960s certificate from Africa

WASHINGTON – California attorney Orly Taitz, who has filed a number of lawsuits demanding proof of Barack Obama's eligibility to serve as president, has released a copy of what purports to be a Kenyan certification of birth and has filed a new motion in U.S. District Court for its authentication.

The document lists Obama's parents as Barack Hussein Obama and Stanley Ann Obama, formerly Stanley Ann Dunham, the birth date as Aug. 4, 1961, and the hospital of birth as Coast General Hospital in Mombasa, Kenya.

No doctor is listed. But the alleged certificate bears the signature of the deputy registrar of Coast Province, Joshua Simon Oduya. It was allegedly issued as a certified copy of the original in February 1964.
WND was able to obtain other birth certificates from Kenya for purposes of comparison, and the form of the documents appear to be identical.

Last week, a counterfeit document purporting to be Obama's Kenyan birth certificate made the rounds of the internet but was quickly determined to be fraudulent. The new document released by Taitz bears none of the obvious traits of a hoax.
One of the issues Taitz must deal with will be the authentication of the document. Critics immediately jumped on the Feb. 17, 1964, date for the document, explaining that the "republic" of Kenya wasn't assembled until in December of that year.
Media Matters wrote, "Sorry, WorldNetDaily: Kenya wasn't a republic until Dec. 1964."
But Kenya's official independence was in 1963, and any number of labels could have been applied to government documents during that time period.
At Ameriborn Constitution News, the researcher noted that the independence process for the nation actually started taking as early as 1957, when there were the first direct elections for Africans to the Legislative Council.
"Kenya became an Independent Republic, December 12, 1963, which gives more [credibility] that this is a true document," the website stated.
The 1963 independence is corroborated by several other information sources, including the online African History.
Even the People Daily news agency cited, on Dec. 12, 2005, the "42nd independence anniversary" in Nairobi. "The country gained independence from Britain on Dec. 12, 1963," the report said.
An online copy of the Kenya Constitution, "adopted in 1963, amended in 1999," states: "CHAPTER I - THE REPUBLIC OF KENYA, Article 1, Kenya is a sovereign Republic. Article 1A, The Republic of Kenya shall be a multiparty democratic state…"
It was in November 1964 when the region voluntarily became a one-party state, according to an online source.
The region including Mombasa originally was dealt with as a separate independence movement, but it almost immediately became part of Kenya when the sultan of Zanzibar ceded the "coastal strip" to Kenya, according to sources.
Taitz told WND that the document came from an anonymous source who doesn't want his name known because "he's afraid for his life."
Taitz's motion, filed yesterday in the U.S. District Court for the Central District of California, requests the purported evidence of Obama's birth – both the alleged birth certificate and foreign records not yet obtained – be preserved from destruction, asks for permission to legally request documents from Kenya and seeks a subpoena for deposition from Secretary of State Hillary Clinton.
"I filed the motion with the court asking for expedited discovery, which would allow me to start subpoenas and depositions even before Obama and the government responds," Taitz told WND. "I am asking the courts to give me the power to subpoena the documents from the Kenyan embassy and to require a deposition from Hillary Clinton so they will be forced to authenticate [the birth certificate].
"I'm forcing the issue, where Obama will have to respond," she said.
"Before, they said, 'You don't have anything backing your claims,'" Taitz explained. "Now I have something. In fact, I have posted on the Internet more than Obama has. My birth certificate actually has signatures."
Taitz's most celebrated case involved a military officer, Maj. Stefan Cook, whose order to deploy to Afghanistan was revoked when he challenged Obama's eligibility to hold office. That case has now been refiled in federal court in Florida, raising the specter of a class-action claim among members of the military that their orders aren't valid because of questions surrounding Obama's constitutional eligibility.
Taitz told WND she plans to file additional paperwork with the Florida court tomorrow, adding the alleged Kenyan birth certificate to Maj. Cook's case.
The suit seeks damages and a declaratory judgment. Named as defendants are Simtech, Cook's former civilian, and several officials, including Col. Louis B. Wingate and Secretary of Defense Robert Gates.
WND previously reported a judge in Georgia dismissed Cook's case when the government suddenly revoked his orders to report to Fort Benning for deployment to Afghanistan.
WND reported when the case originally was filed that Cook's concern was that without proof that there is a legitimate commander in chief, the entire U.S. Army becomes "merely a corps of chattel slaves under the illegitimate control of a private citizen."
Cook told WND: "As an officer in the armed forces of the United States, it is [my] duty to gain clarification on any order we may believe illegal. With that said, if President Obama is found not to be a 'natural-born citizen,' he is not eligible to be commander in chief."
The new complaint says it seeks Cook's reinstatement with his civilian employer, Simtech Inc., as well as protection from the Department of Defense and president "from further retaliation for plaintiff's challenge to the president's constitutional authority."
WND has reported on dozens of legal challenges to Obama's status as a "natural born citizen." The Constitution, Article 2, Section 1, states, "No Person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President."
Some of the lawsuits question whether he was actually born in Hawaii, as he insists. If he was born out of the country, Obama's American mother, the suits contend, was too young at the time of his birth to confer American citizenship to her son under the law at the time.
Other challenges have focused on Obama's citizenship through his father, a Kenyan subject to the jurisdiction of the United Kingdom at the time of his birth, thus making him a dual citizen. The cases contend the framers of the Constitution excluded dual citizens from qualifying as natural born.
Complicating the situation is Obama's decision to spend sums estimated in the hundreds of thousands of dollars to avoid releasing a state birth certificate that would put to rest all of the questions.
