Eric Holder vs. Joe Arpaio?


Maricopa County Sheriff Joe Arpaio has been a controversial figure in the immigration politics debate for some time now, flaunting his hard-line approach to immigration enforcement in a way that rallies fellow hard-liners and engenders his reputation as arch-demon on the left.

Now, the Obama administration is suing him for failing to cooperate with an investigation into his law-enforcement practices--an issue that lies at the heart of the Justice Department's lawsuit against Arizona's SB 1070 law.

The Justice Dept. announced yesterday that Arpaio was refusing to provide documents and that it was suing him.

This is a showdown that, I suspect, many people will want to see. Possibly on pay-per-view. But this lawsuit isn't actually about immigration policies or how Arpaio runs his law enforcement operations. It's about cooperation with the department's investigation. Arpaio seems to be the one who has publicized the department's investigation by refusing to cooperate.

At The Washington Examiner, Byron York doesn't think the probe will go anywhere, and that this whole episode could end in embarrassment for Holder:

Despite the splash of attention from the newest lawsuit, the Justice Department's investigation of Arpaio could end badly for Holder. When the Department first informed Arpaio that a probe was under way, back in March 2009, it sent a letter saying the investigation would focus on "alleged patterns or practices of discriminatory police practices and unconstitutional searches and seizures." But now we learn that just six months before that, in September 2008, the Immigration and Customs Enforcement agency, known as ICE, did its own investigation of Arpaio's office -- and gave it a clean bill of health. Arpaio's lawyers recently got a copy of the ICE report through the Freedom of Information Act.

The investigation of Arpaio may carry more political significance than the Justice Dept. lawsuit against Arizona. Opponents of SB 1070 typically cite police harassment and discrimination as the reasons they think the law is wrong, but the Justice Dept.'s lawsuit against Arizona doesn't really confront those issues. The case against SB 1070 rests on the Constitution's Supremacy Clause and a state's right to make immigration laws. (See a summary of the Justice Dept.'s SB 1070 case here.)

The investigation of Arpaio, however, is a civil-rights investigation. Meaning that, if the Justice Dept. finds him to have violated people's civil rights and decides to sue him over that, we'll get to see Holder's Justice Dept. fight the civil rights battle in a courtroom, and the real political issue will be dealt with.

The SB 1070 suit won't afford us such a showdown, and it's a showdown everyone would want to see. Critics of the SB 1070 lawsuit are rooting for Holder to fail, and they see his department's move as an extension of the Obama administration's liberal immigration stance and its supposed penchant for federal authority. The left sees Arpaio as a symbol of civil rights violations and all that's wrong with the hard line on immigration.

Of course, the department may not find it has a case, and the drama may well just dissipate. Which wouldn't be nearly as exciting.

Explosive evidence shows ruling of AZ judge illegal...

In a stunning development that could potentially send the nation into a Constitutional crisis, an astute attorney who is well-versed in Constitutional law states that the ruling against the state of Arizona by Judge Susan Bolton concerning its new immigration law is illegal.

The attorney in question submitted her assertion in a special article in the Canada Free Press. Her argument states in part,"Does anyone read the U.S. Constitution these days? American lawyers don’t read it. Federal Judge Susan R. Bolton apparently has never read it. Same goes for our illustrious Attorney General Eric Holder. But this lawyer has read it and she is going to show you something in Our Constitution which is as plain as the nose on your face.

"Article III, Sec. 2, clause 2 of our Constitution says:

"In all Cases affecting Ambassadors, other public Ministers and Consuls, and those in which a State shall be Party, the supreme Court shall have original Jurisdiction. In all the other Cases before mentioned, the supreme Court shall have appellate Jurisdiction."

In other words, the Judge in the Arizona case has absolutely no Constitutional jurisdiction over the matter upon which she ruled. As the Constitution makes abundantly clear, only the U.S. Supreme Court can issue rulings that involve a state.

This means that neither Judge Bolton nor the 9th Circuit Court of Appeals in San Francisco , to which the case is being appealed, have any legal standing whatsoever to rule on the issue.

Thus, U.S. Attorney-General Eric Holder filed the federal government's lawsuit against the state of Arizona in a court that has no authority to hear the case.

The attorney whose heads-up thinking concerning the Constitution provides the legal remedy for dealing with this blatant disregard for Constitutional law in the article at Canada Free Press, which can be accessed at the link above.

In a related development, another explosive discovery was made by those who actually take the Constitution seriously. The Constitution specifically allows an individual state to wage war against a neighboring country in the event of an invasion, should there be a dangerous delay or inaction on the part of the federal government. This information was cited by United Patriots of America.

From Article I, Section 10 of the U.S. Constitution, we find these words:

"No State shall, without the Consent of Congress, engage in War, unless actually invaded, or in such imminent Danger as will not admit of delay."

No one who is actually familiar with the crisis at the southern border can deny that Arizona is endangered by the relentless assault of lawless Mexican invaders who ignore our laws, inundate our schools and medical facilities with unpaid bills, and even endanger the very lives of citizens with criminal drug cartels that engage in kidnapping, murder, 115 bodies recovered in AZ entry routes, human trafficking, and other mayhem, including aiming missile and grenade launchers directly at U.S. border cities from just across the Mexican border.

This is as much of an invasion as the nation of Iran sending in a fleet of warships to the Port of Charleston.

The Constitution that forms the basis of the rule of law in this country says that Arizona has legal right to protect itself in the case of inaction or delay on the part of the federal government, including waging war in its self-defense.

This, when coupled with the clear Constitutional mandate that only the Supreme Court hear cases involving the states, should be ample legal basis for attorneys representing Arizona to go after the federal government with a vengeance.

Governor Jan Brewer and the stalwart members of the Arizona legislature have ample legal reason to stand firm against the illegal bullying of an arrogant, lawless federal government.

In her memorandum to Secretary of State Hillary Clinton,
Brewer stated that it was "downright offensive” that a state law would be included in the report, which was drafted as part of a UN review of human rights in all member nations every four years. “The idea of our own American government submitting the duly enacted laws of a state of the United States to ‘review’ by the United Nations is internationalism run amok and unconstitutional,” Brewer wrote. The Obama Administration made public its first-ever report to the United Nations Human Rights Council detailing the condition of human rights in America and subjecting the nation to criticism from countries like Iran, Cuba, China and others. According to the report, the United States violates human rights because of high unemployment rates, hate crimes, poverty, poor housing, lack of access to health care, and discriminatory hiring practices affecting Blacks, Latinos, Muslims, South Asians, Native Americans, and homosexuals. The report also discusses the rate of sexual assault in U.S. prisons and the detention of suspected terrorists at Guantanamo Bay. "It is a disgrace when this President denigrates his own country to curry favor with the despots and thugs at the United Nations. Obviously, President Obama sees America and a global villain," said former intelligence officer and police detective Sid Franes. "When the United Nations first approached U.S. officials about 'human rights inspections," the Bush administration refused to allow any infringement on national sovereignty. Of course, we had Ambassador John Bolton representing us in that corrupt institution and the liberals hated Bolton because he stood up to the UN establishment," he added. The report discusses Obama’s new healthcare and financial industry reforms, and the Lily Ledbetter Fair Pay Act of 2009, which gives women the right to sue employers if they are paid less than men are. Obama also announced his commitment to repeal the military’s so-called “don’t ask, don’t tell” policy. The report also discusses new regulations that increase accessibility for people with disabilities. The report says that it welcomes “observations and recommendations” from concerned members of the U.N. Human Rights Council, which includes countries such as North Korea, Saudi Arabia and Libya. President Obama is hoping these foreign nations “can help us on the road to a more perfect union.” The administration went on to say that “Although we have made great strides, work remains to meet our goal of ensuring equality before the law for all.”
What the Human Rights report did not mention were incidents of physical violence perpetrated against Tea Party participants. It also failed to mention voter intimidation by the New Black Panther Party and the questionable activities of ACORN.

Brewer Pushes Back Against Human Rights Report

Already the front-runner in the Arizona gubernatorial race, Gov. Jan Brewer continued to stake out her anti-Obama administration position on immigration Friday with a sternly-worded letter to Secretary of State Hillary Clinton.

Brewer’s beef was with a report to the United Nations High Commissioner for Human Rights. As part of a 29-page summary of the state of human rights in the U.S., the report mentions concerns over Arizona’s disputed SB 1070 immigration law:

A recent Arizona law, S.B. 1070, has generated significant attention and debate at home and around the world. The issue is being addressed in a court action that argues that the federal government has the authority to set and enforce immigration law. That action is ongoing; parts of the law are currently enjoined.

In her Friday letter to Clinton, Brewer demanded the State Department remove the paragraph in SB 1070, calling the inclusion of the law “downright offensive” because SB 1070 includes provisions for human rights. She also argued the administration should secure the border to prevent high death rates of border crossers.

As Brewer moves closer to the gubernatorial election in November, her tough stance on immigration will make her hard to beat, experts told the Associated Press this weekend. Her opponent, Democrat Terry Goddard, must combat Brewer’s growing notoriety and newfound popularity. Brewer took over as governor after Gov. Janet Napolitano (D) left to join the Obama administration, but saw a boost in her approval ratings after she signed SB 1070.

An Aug. 25 poll put Brewer’s approval rating among Arizona voters above Obama’s. While 65 percent of Arizonans said they approved of Brewer, only 39 percent approved of Obama.

Oklahoma law passed, 37 to 9, had a few liberals in the mix, an amendment to place the Ten Commandments on the front entrance to the state capitol.

The feds in D.C., along with the ACLU, said it would be a mistake.

Oklahoma recently passed a law in the state to incarcerate all illegal immigrants and ship them back to where they came from unless they want to get a green card and become an American citizen.

They all scattered. HB 1804. Hope we didn't send any of them to your state. This was against the advice of the Federal Government and the ACLU, they said it would be a mistake.

Recently we passed a law to include DNA samples from any and all illegals to the Oklahoma database, for criminal investigative purposes.

Several weeks ago, we passed a law, declaring Oklahoma as a Sovereign state, not under the Federal Government directives.

Joining Texas, Montana and Utah as the only states to do so.
More states are likely to follow: Louisiana, Alabama, Georgia, the Carolina's, Tennessee, Kentucky, Missouri, Arkansas, West Virginia, Mississippi, Florida.

Oklahoma, a week ago, passed a law confirming people in this state have the right to bear arms and transport them in their vehicles.

I'm sure that was a set back for the criminals (and Obamaites).

Guess what........... Oklahoma did it anyway.
Just this month, the state has voted and passed a law that ALL driver's license exams will be printed in English and only English and no other language.

They have been called racist for doing this, but the fact is that ALL of the road signs are in English only. If you want to drive in Oklahoma , you must read and write English. Really simple.

The Governor of Arizona is now one of the more important Governors for other Governors and those running for the office to emanate. People are finally saying “Enough is ENOUGH”. More States are looking to adopt the new Arizona law and hopefully they’ll enforce it when they do.

Socialists are crying foul, but it was the socialists who created this problem and I believe so by intent. When 200 Hispanic children illegally walk out of a California school and walk to City Hall to hold their own little protest against Arizona’s new law, chanting all the way there and back, IN SPANISH, “Yes We Can”, does anyone really have to wonder who is behind this? Does anyone really have to wonder who is promoting it? Does anyone have to really wonder why?

200 hundred kids in one school alone, and someone can’t figure out how these kids were lead to believe they have some weird right to expect everyone else to NOT display the American flag on some kind of Cinco De Mayo day celebration here in the United States. If it’s really that hard to guess how this happened just ask yourself a couple questions.

1) “Yes We Can” is whose mantra?

2) Where do 200 kids gather regularly?

The rest should be just as obvious.

The question now is what are we going to do about it?

Do you know who or what is teaching in your child’s school?

Questions for Illegal Aliens: [In English Only]

1. Why are you, among all prospective citizens and citizens alike, above the law?
2. If you love your home country, why do you allow it to self-destruct?
3. Why do you decry the alleged ‘injustice’ of our laws, while your own corrupt government’s laws are so draconian?
4. Why do you call us racists when you call yourselves “THE Race”?
5. Why do you feel you are as entitled to employment and / or welfare in the United States as we are?
6. Why do you feel you do not have to ‘produce your papers’, but we do in order to work, buy or sell, or even for routine traffic stops?
7. So many of you have been terrorized by Human and Drug Traffickers & Cartels, so why would you help them to follow you here? Doesn’t that defeat the purpose of escaping a Narco State?
8. My grandfathers/mothers had to wait months in quarantine, screening and a tedious documentation process to gain entry to the US. Why are you exempt?
9. Do you not understand that you are being made into another dependent class whose only value to the unscrupulous Democrat Party is for harvesting votes? And that you’re discouraged by Democrats from learning English to limit your opportunities thereby keeping you dependent?
10. If all you wish to do is earn an honest living, why can’t you follow our laws honestly?

GLENN BECK: I got a letter from a woman in Arizona. She writes an open letter to our nation's leadership:

I'm a home grown American citizen, 53, registered Democrat all my life. Before the last presidential election I registered as a Republican because I no longer felt the Democratic Party represents my views or works to pursue issues important to me.

Now I no longer feel the Republican Party represents my views or works to pursue issues important to me. The fact is I no longer feel any political party or representative in Washington represents my views or works to pursue the issues important to me. There must be someone.

Please tell me who you are. Please stand up and tell me that you are there and that you're willing to fight for our Constitution as it was written. Please stand up now. You might ask yourself what my views and issues are that I would horribly feel so disenfranchised by both major political parties.

What kind of nut job am I? Will you please tell me?

Well, these are briefly my views and issues for which I seek representation:

One, illegal immigration. I want you to stop coddling illegal immigrants and secure our borders. Close the underground tunnels. Stop the violence and the trafficking in drugs and people. No amnesty, not again. Been there, done that, no resolution. P.S., I'm not a racist. This isn't to be confused with legal immigration.

Two, the TARP bill, I want it repealed and I want no further funding supplied to it. We told you no, but you did it anyway. I want the remaining unfunded 95% repealed. Freeze, and repealed.

Three: Czars, I want the circumvention of our checks and balances stopped immediately. Fire the czars. No more czars. Government officials answer to the process, not to the president. Stop trampling on our Constitution and honor it.

Four, cap and trade. The debate on global warming is not over. There is more to say, discuss, and investigate.

Five, universal healthcare. I will not be rushed into another expensive decision. Don't you dare try to pass this in the middle of the night and then go on break. Slow down!

Six, growing government control. I want states rights and sovereignty fully restored. I want less government in my life, not more. Shrink it down. Mind your own business. You have enough to take care of with your real obligations. Why don't you start there?

Seven, ACORN. I do not want ACORN and its affiliates in charge of our 2010 census. I want them investigated. I also do not want mandatory escrow fees contributed to them every time on every real estate deal that closes. Stop the funding to ACORN and its affiliates pending impartial audits and investigations. I do not trust them with taking the census over with our taxpayer money. I don't trust them with our taxpayer money. Face up to the allegations against them and get it resolved before taxpayers get any more involved with them. If it walks like a duck and talks like a duck, hello. Stop protecting your political buddies. You work for us, the people. Investigate.

Eight, redistribution of wealth. No, no, no. I work for my money. It is mine. I have always worked for people with more money than I have because they gave me jobs. That is the only redistribution of wealth that I will support. I never got a job from a poor person. Why do you want me to hate my employers? Why -- what do you have against businesses and shareholders making a profit?

Nine, charitable contributions. Although I never got a job from a poor person, I have helped many in need. Charity belongs in our local communities, where we know our needs best and can use our local talent and our local resources. Butt out, please. We want to do it ourselves.

Ten, corporate bailouts. Knock it off. Sink or swim like the rest of us. If there are hard times ahead, we'll be better off just getting into it and letting the strong survive. Quick and painful. Have you ever ripped off a Band-Aid? We will pull together. Great things happen in America under great hardship. Give us the chance to innovate. We cannot disappoint you more than you have disappointed us.

Eleven, transparency and accountability. How about it? No, really, how about it? Let's have it. Let's say we give the buzzwords a rest and have some straight honest talk. Please try -- please stop manipulating and trying to appease me with clever wording. I am not the idiot you obviously take me for. Stop sneaking around and meeting in back rooms making deals with your friends. It will only be a prelude to your criminal investigation. Stop hiding things from me.

Twelve, unprecedented quick spending. Stop it now.

Take a breath. Listen to the people. Let's just slow down and get some input from some nonpoliticians on the subject. Stop making everything an emergency. Stop speed reading our bills into law. I am not an activist. I am not a community organizer. Nor am I a terrorist, a militant or a violent person. I am a parent and a grandparent. I work. I'm busy. I'm busy. I am busy, and I am tired. I thought we elected competent people to take care of the business of government so that we could work, raise our families, pay our bills, have a little recreation, complain about taxes, endure our hardships, pursue our personal goals, cut our lawn, wash our cars on the weekends and be responsible contributing members of society and teach our children to be the same all while living in the home of the free and land of the brave.

I entrusted you with upholding the Constitution. I believed in the checks and balances to keep from getting far off course. What happened? You are very far off course. Do you really think I find humor in the hiring of a speed reader to intelligently ramble all through a bill that you signed into law without knowing what it contained? I do not. It is a mockery of the responsibility I have entrusted to you. It is a slap in the face. I am not laughing at your arrogance. Why is it that I feel as if you would not trust me to make a single decision about my own life and how I would live it but you should expect that I should trust you with the debt that you have laid on all of us and our children. We did not want the TARP bill. We said no. We would repeal it if we could. I am sure that we still cannot. There is such urgency and recklessness in all of the recent spending.

From my perspective, it seems that all of you have gone insane. I also know that I am far from alone in these feelings. Do you honestly feel that your current pursuits have merit to patriotic Americans? We want it to stop. We want to put the brakes on everything that is being rushed by us and forced upon us. We want our voice back. You have forced us to put our lives on hold to straighten out the mess that you are making. We will have to give up our vacations, our time spent with our children, any relaxation time we may have had and money we cannot afford to spend on you, to bring our concerns to Washington.

Our president often knows all the right buzzwords like 'unsustainable'. Well, no kidding. How many tens of thousands of dollars did the focus group cost to come up with that word? We don't want your over priced words. Stop treating us like we're morons.

We want all of you to stop focusing on your reelection and do the job we want done, not the job you want done or the job your party wants done. You work for us and at this rate I guarantee you not for long because we are coming. We will be heard and we will be represented. You think we're so busy with our lives that we will never come for you?

We are the formerly silent majority, all of us who quietly work , pay taxes, obey the law, vote, save money, keep our noses to the grindstone and we are now looking up at you.

You have awakened us, the patriotic spirit so strong and so powerful that it had been sleeping too long. You have pushed us too far. Our numbers are great. They may surprise you. For every one of us who will be there, there will be hundreds more that could not come. Unlike you, we have their trust.

We will represent them honestly, rest assured..
They will be at the polls on voting day to usher you out of office. We have canceled vacations. We will use our last few dollars saved. We will find the representation among us and a grassroots campaign will flourish. We didn't ask for this fight. But the gloves are coming off. We do not come in violence, but we are angry. You will represent us or you will be replaced with someone who will. There are candidates among us who will rise like a Phoenix from the ashes that you have made of our constitution.
